A few years ago I bought a 60 yr old house. The real estate agent set up the home inspection with Lighthouse Inspections (Previous name of this company). Although a thorough inspection looked like it was being done, it was found that a couple of weeks after our purchase deal had closed, a crack in the block foundation wall was leaking during severe rain or thaws. I asked my new neighbours if the previous owners had leaks and I was told they had. I was told by the inspector, Marco Ramos, at the time of inspection that there had never been any leaks in this basement. Either the Real estate agent fixed this inspection or Lighthouse was incompetent in their job. I have my own thoughts about how this was missed, but I will keep them to myself. Its a good thing that Home Inspectors are going to have to be licenced in the future. Then a new homeowner will have a recourse for action if this happens to them.

There are limitations during a home inspection that prevent things like previous water leaks and other issues from being detected, we base our observation on what we see at the time we are there. We take pride in the service we provide and the education we give home buyers on their new homes.

It is unfortunate that you have had a leak in the basement but if your new neighbours have told you that the previous owner had leaks in the past and the previous owner didn’t disclose that to you or your Realtor, then that is a LATENT DEFECT and you should have a discussion with your Realtor and lawyer. The previous owners could be held liable in the event that they knew/had leaking in the past.
