On 05 May 2010, I provided them with a deposit of $6,000, to supply and install siding on my home. They were ALWAYS easy to reach and normally returned my calls within a few hours at most. This company is located just outside of Port Perry.
On 10 May 2010, I contacted them via FAX to advise that under the Consumer Protection Act 2002, I was invoking my rights under the act to the 10 day cooling off period, and as such I wished my deposit returned. The Act, permits them 15 days to do so. I also sent them a REGISTERED letter on 11 May 2010, which was signed for on 13 May 2010. This was followed up with a few phone calls to them, (never any answer just a voice mail.
Under the Act they had until 28 May 2010, to return the funds. I have had NO contact from them. On 01 Jun 2010, I filed a formal complaint with the Ministry of Consumer Services.
Amazing how reachable they were UNTIL they got the money. Now they have disappeared from sight, I am left with NO work done and NO refund as of now. I even hoped advising them that the penalty for violating the Act is $50,000 or two years less a day imprisonment for individuals and up to $250,000 fine for corporations.
So if you decide to contact this company I would at best recommend a VERY small deposit, so your not left as I am. Hopefully the "cheque is in the mail"...LOL
