HERE IS STONE-RIDGE PAVING’S RESPONSE to the BBB in response to JLS’s complaint to BBB
On April 14 JLS entered into an agreement /contract with us. He may call it an “illegal” contract but it has been reviewed by a Lawyer prior to printing and it has been binding for the past 16 years. We never provided John with the option to remove his deck at a cost because we are not a contracting company but a “Paving” company. 5 days after signing the contract we excavated the driveway and the trenches for the curbs. If he reviews his contract there is no start or end date stipulated nor was one given at the time of signing the CONTRACT. (Since JLS never requested one) Our company’s (as well as other paving company’s practice) is that once the driveway is dug, the waiting period is 4 -6 weeks for the driveway to be paved. This allows the driveway to settle and the gravel that we laid to harden. If you go to our website you will see this in the illustration of paving a driveway. Unfortunately, JLS took down his own porch prior to being given a completion date. We never advised him to take them down at that point. The week of May 7 we received a phone call from JLS and he was demanding that we attend his job that day to form and pour the concrete. The secretary advised him that we were not able to attend that day but would be able to give him and Mr. L #84 a date. He was rude to our secretary. The other employees in the office overheard his screaming. Our Secretary does not get paid enough to take verbal abuse. On May 9 JLS came to one of our job sites with his son and another individual. He was verbally abusive to the owners and employees. He actually took time out of his busy day to come and harass us on someone else’ property. One of the employees actually thought JLS was going to hit Sal that he ran to them. JLS wants a release from the contract because he states that we did not return to form his concrete curb within 10 working days after we have excavated (not a month as per JLS). As Sal advised JLS we had had several rainy days (7 to be exact) since JLS job was excavated. Depending on how much rain falls we are not able to pour concrete and therefore our forms are tied up on job sites. If JLS wants to cancel his contract he has to provide us with an additional $400 to cover our cost for the work performed at his home ie, excavation, dumping, gravel, employee costs, gas, fuel, and our time. We cannot control Mother Nature and therefore it is not due to our lack of professional service that we could not make impatient customers happy. In addition, we would like the BBB to advise JLS if he ever attends any of Stone Ridge’s job sites again the police will be called and harassment charges will be laid. We no longer want to do any work for him.

We were contacted by the Smith's this past week and on Sunday August 22 we attended their home. We reviewed their complaint and decided that the issue was not to our fault and therefore was not a warranty issue. When we originally attended the home to provide them with a new driveway Sal from Stone-Ridge had advised Mrs. Smith that we had found a broken cable and pipe on the bottom portion of her driveway and recommended that she get it fixed and we would return at a later point. Obviously this recommendation would have costed us as we had already brought our crew and equipment to her home, paid travelling costs to the employees and had excess asphalt sitting in our truck. Mrs. Smith indicated that she didn't care because she was selling her home and to go ahead and do it even though we told her that he driveway would break/ crack. We followed her instructions.
Mrs. Smith is complaining that she has a hairline crack on the top portion of her driveway. On Sunday we advised her that the area has a hairline crack because she has a city tree root growing under her driveway and has caused upward pressure on her driveway. As indicated in our warranty clause in our contract this is not warrantied since we cannot control this external factor. Mrs. Smith insisted that we redo her driveway. We advised her that even if we wanted to redo the driveway it would crack again since the issue (the tree root) would still exist. She insisted that there is no tree root.
HOWEVER, in order to provide good customer satisfaction we advised Mrs. Smith that were willing to provide her with 3 options. (1) We would remove the driveway asphalt and if there was a tree root she would have to have it removed and then pay our expense at cost to have her driveway repaved. She disagreed. (2) We can fill in the hairline crack with new technology and have her driveway sealed at our cost. She disagreed. (3) Lastly, we walkaway as it is not our fault.
Mrs. Smith threatened to make Stone-Ridge's life miserable by using her authority.
Please note that the Smith's say that they were told of our supposed "reputation" from their mother and brother-in-law, then why would a reasonable person go with the same company.
We strive to be #1 in our industry and provide excellent customer satisfaction. We do not like to be taken advantage of. We are based on referrals and therefore keeping our clients happy and doing a good job is important to us. Before taking Mr. and Mrs. Smith's advice seriously kindly attend their home [address removed--Ed] and look at their driveway.
Stone-Ridge Paving would like to take this opportunity to clarify Michelle’s concerns:
1.Our company advertisement offering $100.00 discount applies to jobs which exceed $1000.00. Michelle’s neighbour’s driveway exceeded $1000 and therefore qualified for the discount.
2.Our company received one phone call from Michelle a few weeks after her driveway was completed and the concern/complaint was an animal urine stain on the driveway. Michelle did receive a visit shortly after her initial call regarding the matter and confirmed that in fact it was an animal urine stain. Unfortunately Stone Ridge Paving cannot guarantee a stain free driveway.
3.Michelle was once again visited directly by the owner of Stone Ridge Paving after her claim against Stone Ridge Paving with the BBB and has since resolved this issue through additional communications.
4.Michelle was never once mislead regarding discounts and had an opportunity to choose another contractor if she felt uncomfortable about the terms of our discount.
5.Stone Ridge Paving understands and appreciates Michelle’s concerns and we apologise if the terms of our discount did not meet her expectations.
6.Stone Ridge Paving customer service is taken seriously and we address our customers concerns as per the terms of our contract.
